1. Agreement to Terms

By accessing or using CrewComm ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

CrewComm is a real-time messaging platform designed specifically for live event technical teams. The Service enables silent communication between team members during events through dedicated team rooms and instant messaging.

We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.

3. User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

Account Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any laws, regulations, or third-party rights
  • Transmit harmful, offensive, or inappropriate content
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Transmit spam, viruses, or malicious code

5. User Content

Your Content

You retain ownership of any content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant CrewComm a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your User Content solely for the purpose of operating and providing the Service.

Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate these Terms or any laws
  • Your User Content does not infringe on third-party rights

Content Removal

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, at our sole discretion, without notice.

6. Subscription Plans and Billing

Free and Paid Plans

CrewComm offers both free and paid subscription plans. The features and limitations of each plan are described on our website.

Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • All fees are in USD unless otherwise stated
  • Payments are non-refundable except as required by law
  • We may change pricing with 30 days notice to existing subscribers
  • Failure to pay may result in suspension or termination of your account

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will not receive a refund for the remaining time in your billing period.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by CrewComm and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission. You may not modify, reproduce, distribute, or create derivative works based on the Service without our express permission.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by CrewComm. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by use of such services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Accuracy, reliability, or completeness of content

We do not warrant that the Service will meet your requirements or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREWLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers or personal information
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or similar issues transmitted through the Service
  • Any errors or omissions in content
  • Any user content or conduct of third parties

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless CrewComm, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Violation of applicable laws
  • Fraudulent, harassing, or abusive behavior
  • At our sole discretion

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CrewComm operates, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in that jurisdiction.

14. Dispute Resolution

Any dispute arising from these Terms or the Service shall first be resolved through good faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration in accordance with the rules of a recognized arbitration association.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, along with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and CrewComm regarding the Service and supersede all prior agreements.
